Having completed a trial in the criminal case against Azra Miletić, on 3 August 2017, the Court of Bosnia and Herzegovina delivered a trial judgment, finding the accused Azra Miletić guilty that as an official person in the institutions of Bosnia and Herzegovina she received a promise of a gift and received the gift, in order to do, in the framework of her powers, something she is not supposed to do, whereby she committed the criminal offense of Accepting Gift and Other Forms of Benefit under Article 217(1) of the CC BiH.

In that regard, the Court sentenced her to 2 (two) years and 6 (six) months of imprisonment. In terms of Article 56 of the Criminal Code of Bosnia and Herzegovina, the time she spent in pre-trial custody, from 25 February 2015 to 23 March 2015, shall be credited towards her prison sentence.

Pursuant to Article 69(1)c), as read with Article 73 of the CC BiH, also imposed on the accused Azra Miletić was the security measure of a ban on performing a professional duty – judicial office holder, for a period of 3 (three) years, running from the moment the judgment becomes final, on proviso that the time spent serving the sentence shall not be credited towards this security measure.

Pursuant to Article 284, Subparagraph c), of the Criminal Procedure Code of BiH, the accused Azra Miletić has been acquitted of the charges that, as a judge of the Court of Bosnia and Herzegovina, with the aim of obtaining benefits for another person, she broke the law in performing her official duties, whereby she would have committed the criminal offense of Violation of Law by a Judge under Article 238 of the CC BiH.
