Level of Independence
– Permanence: Law no. 9110, dated 24.07.2003
– Appointment: General Prosecutor candidates are appointed to office by the President of the Republic on the proposal of the General Prosecutor on the basis of the results of public competition.
– Removal: Law 8737: 1. A prosecutor is removed from duty in these cases: a) when he resigns; b) when he reaches the age of 65; c) when his juridical capacity to act is removed or limited by a final court decision. 2. After he has received the consent of the prosecutor himself, the General Prosecutor may decide to keep on duty a prosecutor who has reached the retirement age contemplated in letter “b” of point 1 of this article. 3. A prosecutor is discharged from duty in these cases: a) when he is punished for a criminal offense by a final court decision; b) when a disciplinary measure according to letter “d” of article 32 of this law is taken; c) when he is evaluated as incompetent in accordance with points 3 and 4 of article 42 of this law.

Structure: headed by General Director; divided into four main departments: Department of Organized and Serious Crimes, Department of Public Safety, Department of Border & Migration Control, Department of Support Services
Competencies: supervises the performance of police functions and duties by the Regional Police Directorates; receives and investigates complaints from citizens against police officers

– Financial Autonomy: Based on article 137 of the above law, the budget of the State Police is a separate program within the ministry’s budget, called “ASP”. The director of this program is the Director of the State Police and the budget program is approved in the annual budget law. Moreover, there is a special budget for operation and other needs, which is also solely managed by the ASP Directorate.
