Level of Independence
– Permanence: OG 42/02 Law on Organization and Jurisdiction of Government Authorities in Suppression of Organized Crime, Corruption and Other Severe Criminal Offences
– Appointment: Prosecutor for Organized Crime is selected by State Prosecutorial Council
– Removal: A public prosecutor and deputy public prosecutor may be suspended from duty when remanded in custody.
A public prosecutor and deputy public prosecutor may be suspended from duty when proceedings for their dismissal, or a criminal procedure for a dismissible offence, have been instituted. A public prosecutor decides on the mandatory suspension of a deputy public prosecutor, while a directly higher ranking public prosecutor decides on the mandatory suspension of a public prosecutor. The Republican Public Prosecutor takes decision on non-mandatory suspension.
